Update from Wetpaint
Jan 17 2013, 1:51 PM EST | Post edited: Jan 17 2013, 1:51 PM EST
Hi all – Alex Weinstein here, head of technology at Wetpaint.

Over the past few weeks, we have received a number of complaints from the Wetpaint community about wikis created that contain a variety of offensive material, and therefore violate Wetpaint’s Terms of Service. To preserve the health of the community and provide better service to those that abide by our Terms of Service, we have made a decision to:

- Immediately terminate any wikis that violate our Terms of Service; and
- Cease creation of new wikis until we are able to deploy tighter controls for this sort of Terms of Service violations.

Existing wikis will continue functioning without interruption, with improved performance due to freed up hardware capacity. In the coming 3 months, we are planning to upgrade the server hardware for the Wetpaint Wiki platform to further improve wiki page load performance.

Thank you.

Hello Mr. Weinstien,

It's great to hear that Wetpaint is dedicated to improving performance for the wiki platform. Freeing up hardware capacity will definitely lead to faster loading times. However, at this point in time, the wikis are loading at a fast enough rate for me. Since the beginning of the new year, my colleagues and I have discussed pressing maintenance issues with over 250 members of the wiki community. The wiki community has concluded that, along with increased loading speed, the return of mass messaging would be very beneficial to the continued success of the wiki platform.

When the mass messaging system was functional, every moderator and administrator on Wetpaint relied on it in order to keep their members informed of their site's daily occurrences. When the mass messaging system stopped working, every moderator and administrator on Wetpaint lost the means of convenient communication with the members of their wikis. Many wikis have tried to cope with the situation by developing other methods to communicate with their members; however, none of these new methods are fruitful. For example, on Warrior Cat Clans 2 Classic, the Staff Members created a newspaper in order to keep their members informed. Unfortunately, there are few members that check the newspaper on a daily basis. Even though the Staff Members have encouraged their members to check the newspaper daily, there are very few members who comply with these demands. This lack of communication has caused a decline in the retention rate of every wiki on the wiki platform.

Every member of the wiki community would be grateful to Wetpaint if mass messaging could be included as another product of improved performance to the wiki platform. With that in mind, my colleagues and I, along with the entire community, appreciates your efforts to improve any portion of the wiki platform.

-Matt

Thanks for your message, and for the promise to fix page loading issues.

As the Head Judge of the Golden Paint Can Awards, I would like to know approximately how long users will not be allowed to create new wikis, as the Emerging award Category is for wikis that are created between January 31, 2013 and August 1, 2013.

Thanks!

Although reply # 4 and mine # 5 are off topic to this thread, it needs to be addressed.

This issue is really not the complaining, but the violation of the TOS. The complaints only brought attention to those violations.

How many members were on that wiki that were under the age of 18? I can name several.

It is a cartoon porn site and violates the TOS. We don't need that type of trash (in my opinion) on these platforms. It should of been locked years ago if its been in operation that long. If any wiki violates the terms of service there is no need to talk about it. It is just locked off.

If there a violation then maybe it is fair to give the administrator a chance to fix it.Now about the fact that some members are underage.
The wiki works just like any other adult site works and so it's in no way responsible for the actions of individuals. It's job was to notify the viewer that the content is available only to "grown ups" and it does that.
Yes there might be some underage persons accessing the site but this doesn't mean that the wiki and everybody else has to pay for it.

Hey Anonymous,

His account was banned on Wetpaint Central. As you can see, a few minutes ago, Clay unbanned the account. It can be assumed that Alex could not post on his real account due to the fact that it was banned from Wetpaint Central. His account is currently unbanned, so I assume that he'll provide future updates on his actual account. Plus, if you haven't noticed, the shutdown of Yaoi Haven and Alex's announcement of stricter enforcement of the Wetpaint Terms of Service go hand in hand with each other. Only Wetpaint has the power to block sites. If the Yaoi Haven Wiki did infringe upon the Wetpaint TOS, the wiki was blocked, and Alex's post would be authentic.

Plus, after talking to my colleagues, Clay has confirmed with our contact at Wetpaint that Alex's post is, in fact, authentic. With this information now available, I'd like us to return to the topic at hand instead of discussing the validity of Alex's post. If you guys have any relevant questions, comments, or concerns, please post them below. If your comments are irrelevant, please refrain from posting them.

I can see where you're coming from with it being here for years, it does seem a bit strange to let such a well known site go on for that long and then suddenly get rid of it now.

But now that it's happened, we just need to stop complaining and go re-build it somewhere else where it's allowed.

This has nothing to do with other porn sites, or the fact people under 18 was on Yaoi Haven.

What Wetpaint is explaining to all the members of the wiki, or at least trying to, is this, which comes from the Terms of Service:

You agree to not use the Site to:

Upload, post, email, transmit, or otherwise make available any content that we deem to be unlawful, harmful, threatening, abusive, bullying, harassing, false, inaccurate, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that violates any applicable law;
Upload, post, email, transmit or otherwise make available any content that we deem adult or pornographic in nature.

The following also comes from the TOS:

Wetpaint reserves the right to remove sites from public view, delete, or purge the content with or without cause, with or without notice for any reason, including, without limitation if we determine in our sole discretion that the content is harmful, offensive, illegal, or inappropriate for the subject matter of the Site. Furthermore, Wetpaint may terminate this Agreement, or terminate or suspend your access to the Site and remove and discard any Submissions at any time, with or without cause, and with or without notice.

Both of the wikis mentioned in this thread have been determined as violators of Wetpaint Terms of Service. This is the bottom line. Both violated the first two paragraphs governing Wiki Conduct:

  • Upload, post, email, transmit, or otherwise make available any
content that we deem to be unlawful, harmful, threatening, abusive,
bullying, harassing, false, inaccurate, tortuous, defamatory, vulgar,
obscene, libelous, invasive of another's privacy, hateful, or racially,
ethnically or otherwise objectionable, or that violates any applicable
    law;
  • Upload, post, email, transmit or otherwise make available any content that we deem adult or pornographic in nature.

Read those two highlighted sections very carefully. Notice in the second bulleted item, where is says "any content WE deem adult or pornographic in nature. This does not mean what YOU find exceptable or other websites find exceptable. It means WETPAINT is the judge.

"That's like saying that all porn sites should be shut down because minors go to the site."
When you joined Wetpaint, you agreed to adhere to the Wetpaint Terms of Service. The two excerpts from above explain why these wikis were shut down. I will post the two sections from the TOS until everyone understands it. As a member of Wetpaint, you are not allowed to do the following:

"Upload, post, email, transmit, or otherwise make available any content that we deem to be unlawful, harmful, threatening, abusive, bullying, harassing, false, inaccurate, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that violates any applicable law. Upload, post, email, transmit or otherwise make available any content that we deem adult or pornographic in nature."

When you joined Wetpaint, you agreed to the Wetpaint TOS. If your site was shutdown by Wetpaint, it violated one of the two clauses above. This is not our fault; it is not Wetpaint's fault; it's your fault for not adhering to the TOS. As CryingDove said, Wetpaint is the judge, not you. Wetpaint cannot control the Internet, so they cannot combat major pornography sites on the Internet, but they have the power to ensure that their platform is not cluttered with pornographic material. If Wetpaint deems that your site contains pornographic material or adult content, it will be blocked. There is nothing you can do about it except migrate the content on your site to a different platform.

EDIT: Wetpaint is not required to warn you before they delete your site. As quoted from the Wetpaint TOS, "Wetpaint reserves the right to remove sites from public view, delete, or purge the content with or without cause, with or without notice for any reason."

So what I'm understanding..Is that this site has been, according to the TOS, violating the TOS rules for the 3 years that it's been active.

Minors, complaints, and over 18 content are not the issues here. The issue is just that this content is on Wetpaint, and Wetpaint doesn't want it there anymore, based on their rules.

I see two oversights here..One by the creator of Yaoi Haven (unless the TOS rules have recently changed.) Shoulda made the site in the kind of place that would have allowed it. The other oversight is by Wetpaint. If these kinds of sites are not allowed by them, then they shouldn't have allowed it to be created in the first place (They have had years to see it after all.) Two, if the TOS rules did in fact change they should have notified the owner that they were in violation of them.

Either way, to be fair and all. Wetpaint should at least allow the owner of Yaoi Haven to clean everything up and gather their data so they can move on to a place where they would not be in violation of the TOS. Surely you can give them a period of time in which to do so? (Like when a land lord kicks out a renter...)

We obviously want to have our site, whatever type of site it may be, to be able to exist. Even if it's not with Wetpaint. Surely we it ca be re-built somewhere else, and it would be in Wetpaints best interest to help towards that. (At least talking with the site owner..etc...)

The information about WP's actions have been discussed. Also, justifications have been identified for wikis being blocked. I think this thread should be locked and used as a reference for other inquiries. Or else this thread will become a complaint thread instead of a thread of joy about WP looking into the slowness issue.

Wait..Porn isn't illegal. I think it was simply a violation of the TOS.

Very well, you all know what is up now. Please refrain from posting any further complaints. Wetpaint will hopefully keep us posted on any further changes.

As for the complaints of not being able to get the content, this section of the TOS mightprove relevant:
Although Wetpaint does not claim ownership of Submissions that its users post, by posting or submitting Submissions to the Site, you automatically grant and represent and warrant that you have the right to grant to Wetpaint an irrevocable, perpetual, non-exclusive, fully paid, royalty-free, worldwide license to use, copy, perform, modify, adapt, publish, display, translate, and distribute said Submissions and to prepare derivative works of, or incorporate into other works said Submissions and to grant and authorize sublicenses (through multiple tiers) of the foregoing, including as set forth in Paragraph 7 below. Furthermore, by posting Submissions to the Site, as part of the Collective Content, you automatically grant Wetpaint all rights necessary to prohibit any subsequent prohibited aggregation, display, copying, duplication, reproduction, or exploitation of the Collective Content by any party for any purpose.

Thanks!
